Internet Governance in Brazil

and the political uncertainties involved, a group of civil society and
academic organizations has produced this public declaration in defense

of the multistakeholder nature of CGI.br and its attributions.LETTER IN SUPPORT OF THE ATTRIBUTIONS AND MULTISTAKEHOLDER NATURE OF CGI.BR

The Internet Steering Committe of Brazil, CGI.br, a multistakeholder
commission, has a crucial mission in the development of the Internet in
Brazil. In particular, CGI.br supervises the actions of NIC.br - a
non-profit private civil society organizationm in charge of carrying out
the management of all activities derived from policies defined by the
Committee. Decree Number 4829, of September, 2003, describes
attributions of CGI.br, which include:

- proposing policies and procedures regarding the regulation of Internet
activities;

- recommending standards for technical and operational procedures for
the Internet in Brazil;

- establishing strategic directives related to the use and development
of the Internet in Brazil;

- promoting studies and technical standards for network and service
security in the country;

- coordinating the allocation of Internet addresses (IPs) in Brazil and
registration in the ".br" domain;

- collecting, organizing and disseminating information on Internet
services, including indicators and statistics;

- be represented in national and international technical forums related
to the Internet;

- to adopt administrative and operational procedures so that Internet
governance in Brazil follows internationally accepted standards,
enabling it to celebrate agreements and partnerships.

These activities, fully funded by private income derived from
distribution of domain names and IP numbers, are essential for the
operation and development of the Internet in Brazil. These attributions
are being carried out in a multistakeholder approach, with participation
of civil society, academia, technical community, private sector and
government.

This pluralist feature has been the basis for the charter of principles
which is at the origin of the Brazilian Civil Rights Framework for the
Internet ("Marco Civil da Internet"). The success of this pluralist
practice has turned CGI.br into a worldwide reference on Internet
governance, considering that since its creation in 1995, and even in the
preparation of the Decree of 2003, any change in its structure and
operation has been preceded by broad consultations with society,
including significant participation of civil society and academic
organizations.

In order to protect the stability, security and quality of the work
which has been and continues to be carried out and developed by the
Committee, the undersigned organizations affirm the centrality of CGI.br
to develop activities absolutely vital for the Internet of today and
tomorrow in the country, stressing the importance of preserving the
above attributions, as well as the pluralist, multissectorial nature of
CGI.br.

CARTA EM APOIO ÀS ATRIBUIÇÕES E CARÁTER MULTISSETORIAL DO CGI.BR

O Comitê Gestor da Internet no Brasil - CGI.br, uma comissão
multissetorial, tem missão crucial no desenvolvimento da Internet no
Brasil. Em particular, o CGI.br supervisiona as ações do NIC.br -
sociedade civil sem fins lucrativos de direito privado encarregada da
realização e administração de todas as atividades decorrentes das
políticas definidas pelo Comitê. O Decreto Nº 4.829, de setembro de
2003, descreve como atribuições do CGI.br:

- estabelecer diretrizes estratégicas relacionadas ao uso e
desenvolvimento da Internet no Brasil;

- estabelecer diretrizes para a organização das relações entre o Governo
e a sociedade, na execução do registro de Nomes de Domínio, na alocação
de Endereço IP (Internet Protocol) e na administração pertinente ao
Domínio de Primeiro Nível (ccTLD - country code Top Level Domain), " .br
", no interesse do desenvolvimento da Internet no País;

- propor programas de pesquisa e desenvolvimento relacionados à
Internet, que permitam a manutenção do nível de qualidade técnica e
inovação no uso, bem como estimular a sua disseminação em todo o
território nacional, buscando oportunidades constantes de agregação de
valor aos bens e serviços a ela vinculados;

- promover estudos e recomendar procedimentos, normas e padrões técnicos
e operacionais, para a segurança das redes e serviços de Internet, bem
assim para a sua crescente e adequada utilização pela sociedade;

- articular as ações relativas à proposição de normas e procedimentos
relativos à regulamentação das atividades inerentes à Internet;
ser representado nos fóruns técnicos nacionais e internacionais
relativos à Internet;

- adotar os procedimentos administrativos e operacionais necessários
para que a gestão da Internet no Brasil se dê segundo os padrões
internacionais aceitos pelos órgãos de cúpula da Internet, podendo, para
tanto, celebrar acordo, convênio, ajuste ou instrumento congênere.

Essas atividades, todas financiadas com os recursos privados decorrentes
da distribuição, pelo NIC.br, de nomes de domínio e números IP, são
essenciais para a operação e desenvolvimento da Internet no Brasil. Tais
atribuições têm sido desenvolvidas em uma lógica multissetorial, com
participação de sociedade civil, academia, comunidade técnica, setor
privado e governo. Este caráter pluralista foi base para a carta de
princípios que originou o Marco Civil da Internet. Característica que
fez também do CGI.br uma referência mundial de governança da Internet,
sendo que, desde sua criação em 1995, e até mesmo na elaboração do
Decreto de 2003, qualquer mudança no seu modus operandi foi precedida de
ampla consulta com a sociedade, incluindo forte participação da academia
e da sociedade civil.

Visando proteger a estabilidade, segurança e qualidade dos trabalhos que
já foram e seguem sendo realizados e desenvolvidos pelo Comitê Gestor da
Internet, as entidades abaixo vêm, por meio desta, afirmar a
centralidade do CGI.br para desenvolver atividades absolutamente vitais
para a Internet que temos hoje e teremos no futuro no país, destacando a
importância de se manter tais atribuições, bem como o caráter pluralista
e multissetorial do CGI.br.
